Terms of Service

These Terms of Service ("Terms") govern your access to and use of usrecoveryservices.org (the "Site") and any services provided by US Recovery Services ("USRS", "we", "us"). By using the Site or engaging our services, you agree to these Terms. If you do not agree, please do not use the Site or our services.
1. Our services
USRS assists businesses in identifying and recovering unclaimed property held by state, federal, and other holding agencies. Our services include database searches, preparation of claim documentation, notarization, filing with the appropriate agency, and follow-up through the recovery cycle.
2. Free search and no-obligation review
Initial property searches are free and carry no obligation. We will share the results of any search with you and will not take action on your behalf without your written authorization.
3. Fees and payment
Our fee is a flat contingency of ten percent (10%) of amounts successfully recovered on your behalf. This fee covers all associated costs — search, document preparation, notarization, filing fees, and follow-up — unless we agree otherwise in writing.
No recovery, no fee. If we are unable to recover funds for you, you owe us nothing. Our fee is deducted from the recovered amount at the time of remittance, and the balance is paid to you.
4. Authorization
By engaging us, you authorize USRS to act as your agent solely for the purpose of identifying, preparing, filing, and pursuing unclaimed property claims on behalf of your business. The scope of this authorization is set forth in our written service agreement. You may revoke this authorization in writing at any time, subject to any claims already in progress.
5. Accuracy of information
You agree to provide accurate, current, and complete information when requested. USRS is not responsible for delays, denials, or losses resulting from inaccurate, incomplete, or fraudulent information you provide.
6. Third-party agencies
Processing times, documentation requirements, and claim outcomes are determined by the relevant holding agency and are outside our control. We make no guarantees regarding the timing, amount, or success of any particular claim.
7. No legal, tax, or financial advice
USRS is not a law firm, accounting firm, or financial advisor. Nothing we provide constitutes legal, tax, or financial advice. You should consult a qualified professional for advice about your specific circumstances.
8. Limitation of liability
To the maximum extent permitted by law, USRS and its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly, arising out of or relating to your use of the Site or our services.
In no event shall our aggregate liability exceed the amount of fees you have actually paid to us in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.
9. Indemnification
You agree to indemnify and hold USRS harmless from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your breach of these Terms or misuse of our services.
10. Governing law
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles. Any disputes arising under or related to these Terms shall be resolved exclusively in the state or federal courts located in Los Angeles County, California.
11. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Material changes will take effect thirty (30) days after posting. Your continued use of the Site or our services after changes take effect constitutes acceptance of the revised Terms.
